FasCast Privacy Policy
Company takes precautions regarding Client information and personal data, as well as all of Client’s subscriber’s information. Client values and respects Client’s and their subscriber’s privacy. Through the course of standard business, Company may collect information about its Clients and their subscribers in order to provide our Services and to communicate with you about our services and promotions. Neither Client’s information nor any personal information about Client’s subscribers is sold or shared with any non-affiliated company or agency. However, as described in greater detail below, we may share your information under certain circumstances.
This Privacy Policy describes the personal information Company collects from Client, why it is collected, how Company uses it, and when Company shares the information with third parties. This Privacy Policy also describes the choices Client can make about how we collect and use certain information.
(A) Information Collected.
Company will ask Client for certain information to provide the Services Client request. Information provided by Client is not used for any purpose other than as outlined in this Agreement. This information may include:

(i) Email List - When Clients create an account with Company, the Client may be added to Company’s promotional email mail list. The Information will never be shared with or sold to third parties. To request Client’s subscribers be removed from the promotional email list, please call, or have Subscriber call Company at 314-300-5605 and include Subscriber’s name and email address, or click the “unsubscribe” button found at the bottom of the emails we send you.

(ii) Phone Lists - Before sending a SMS text message or voice broadcast, Client will provide Company with a list of phone numbers and other optional information for the people Client would like to Company to contact. This information will not be shared with any third parties, pursuant to this Agreement.

(iii) Voice Broadcasts / Recordings - Company will record Client’s voice inputs (messages) in order to transmit them to the phone numbers Client provides. Company reserves the right to review these messages at any time and for any reason, particularly if Company has reason to believe that messages are in violation of this Agreement.
(B) Sharing Information with Third Parties.
Company does not share, sell or trade Client’s or their subscribers’ Information gathered with any third parties, except with Client’s consent or as described herein. Company does not contribute to or participate in cooperative databases, which give other companies access to such Information.

(i) Company may disclose Information when legally required to do so, to cooperate with law enforcement investigations or other legal proceedings, to protect against misuse or unauthorized use of Company Services, to limit Company’s legal liability and protect Company’s rights or to protect the rights, property or safety of other Clients.

(ii) Company may also disclose Information to outside individuals and/or companies that assist Company bring Client the products and Services we offer and to create, operate, and maintain Company’s Website. For example, Company may work with third parties to: (a) manage a database of customer information; (b) assist Company in distributing e-mails; (c) assist Company with direct marketing and data collection; (d) provide data storage and analysis; (e) provide fraud prevention; (f) provide customer service; and (g) provide other services designed to assist Company in developing and running Company’s Website and maximizing Company’s business potential. Company requires that these outside companies agree to keep all information shared with them confidential and to use the information only to perform their obligations to Company.

(iii) In addition, if Company shall go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of Company’s assets, Client’s Information will be among the assets transferred. In the event that Company, or substantially all of its assets are acquired, Client consents to the transfer of Client’s Information as one of the transferred assets, pursuant to client approval with novation of contract.
(C) Security.
Company strives to keep Client’s and their subscribers Information private and safe. Company makes commercially reasonable physical, electronic and administrative steps to maintain the security of Information collected, including limiting the number of people who have physical access to database servers, as well as employing electronic security systems and password protections that guard against unauthorized access.
However, the transmission of data over some mediums, such as the Internet, cannot be guaranteed to be absolutely secure. While Company will use every reasonable means to ensure the security of transmitted Information, Company cannot guarantee that such information will not be intercepted by third parties. Company will, however, prosecute
any unauthorized or fraudulent transactions to the fullest extent permitted by law.
